Uninsured Vehicles

General

MIBI compensates victims who have been involved in road traffic accidents caused by uninsured vehicles.  If you wish to notify us of a claim please complete the online claim form here.  Any relevant documentation relating to the incident or the alleged offending vehicle should be uploaded when completing the online claim form.

The Claim Notification Form should be fully completed and returned to us either by email (info@mibi.ie) or by registered post. Any relevant documentation relating to the incident or the alleged offending vehicle should also be submitted along with the Claim Notification Form.  Time-limits for notification of personal injury claims is two years from the date of accident and six years for property/vehicle damage claims.

PLEASE SUBMIT THE CLAIM NOTIFICATION FORM AS SOON AS POSSIBLE AFTER THE ACCIDENT TO ENABLE MIBI TO COMMENCE INVESTIGATIONS.

Vehicle/Property Damage Claims

The MIBI Agreement provides for the payment of compensation of vehicle/property claims however the alleged offending vehicle must be identified by means of a valid registration plate.  In instances where the alleged offending vehicle cannot be identified by means of a valid registration plate MIBI has no liability to pay compensation for vehicle/property damage [unless there are significant personal injuries arising from the same accident].

MIBI No Claims Discount Protocol

Where the damaged vehicle is comprehensively insured MIBI has agreed with its Member Companies, under the terms of MIBI No Claims Discount Protocol that the vehicle insurer will deal with the vehicle damage claim.  The Protocol guarantees protection of the claimant’s motor No Claims Bonus. In addition in the case of accidents that occured after June 2020 your motor policy insurer will not deduct or charge you any policy excess. Where a property is damaged by an uninsured vehicle, and where that property is covered by a policy of insurance, the claimant must make a claim against that insurance policy. MIBI will refund any policy excess however the claimant’s house insurance No Claims Discount may be impacted by the property insurer.

Personal Injury Claims

The MIBI Agreement provides for the payment of compensation for personal injury claims in respect of road traffic accidents caused by uninsured vehicles.

What happens next?

On receipt of a fully completed MIBI Claim Notification Form we will commence our investigations.  Please note only the receipt by MIBI of a fully completed and signed MIBI Claim Notification Form will constitute formal notification of a claim.  Our initial investigation includes (a) establishing the facts, (b) establishing the insurance position of the alleged offending vehicle and/or driver and (c) obtaining a Garda Report.

When all requisite information is received, including, insofar as is possible, confirmation that the alleged offending vehicle was uninsured, MIBI will pass the claim to one of our Claims Management Service Providers to continue and complete the investigation.  They will accept Injuries Board notification or service of proceedings.  In due course, following thorough investigation of the circumstances and liability, the claim will be settled by our Claims Management Service Provider, on our behalf, and compensation paid as appropriate.

Personal Injuries Assessment Board

The Personal Injuries Assessment Board (PIAB) assesses the amount of compensation to be paid to claimants in respect of personal injury suffered by claimants injured, inter alia, in road traffic accidents.  To see more information, and to make an application to PIAB, please see https://www.piab.ie/eng/
