General:
MIBI deals with claims from parties involved in accidents caused by uninsured and unidentified vehicles. If you wish to make a claim on line against such a vehicle, click here. Should you wish to download and print the claim notification form please click here. You should then complete the Claim Notification Form with as much accurate information on the accident and the vehicles and parties involved as possible and submit to MIBI by either e-mail or registered post. Please retain any documentation you have obtained from the other driver. The time taken to process your claim is likely to be reduced if we have more information available.
Time-limits for Personal Injury claims under the MIBI Agreement 2009 are in line with Irish statutory provisions.
What happens next?
We will write to you or your representative to confirm that we have received your claim.
We will start our investigations as soon as possible.
Our investigations are likely to include:
- Establishing the facts
- Establishing the insurance position of the offending driver and vehicle.
- Obtaining a Garda Report on the accident
- If applicable, obtaining a Motor Assessor’s Report on the damage to your vehicle.
If you are claiming for personal injury we will need to obtain:
- Copies of your medical records from your doctor and any hospital attended after the accident.
When all requisite information is provided and verification of the circumstances of the accident is complete MIBI will pass the claim to one of our Claims Management Services Providers to complete the investigation and to accept service of proceedings or PIAB notification. In due course, following thorough investigation of the circumstances and liability, the claim will be settled by our Claims Management Services provider and compensation paid as appropriate.
PLEASE SUBMIT THE CLAIM NOTIFICATION FORM AS SOON AS POSSIBLE AFTER THE ACCIDENT TO ENABLE MIBI TO COMMENCE INVESTIGATIONS.
Personal Injury Claims:
The MIBI compensation scheme covers Personal Injury claims irrespective of whether the offending vehicle is identified or not. Compensation for Personal Injury may be payable, subject to liability, in all cases where the offending vehicle is uninsured or cannot be identified.
Property Damage Claims:
It is not always possible to claim compensation for vehicle or property damage under the MIBI compensation scheme. Where the offending vehicle is not identified there is no provision in the 1988 or the 2004 MIBI Agreements to recover losses for vehicle or property damage. The 2009 Agreement introduced compensation for vehicle or property damage against an unidentified vehicle where there are significant personal injuries arising from the same accident. There is a time-limit of one year from the accident date in which to apply for compensation for vehicle and property damage under the 1988 and 2004 MIBI Agreements.
As stated above the time limit for vehicle and property damage claims under the 2009 MIBI Agreement is in line with Irish statutory provisions.
There are excesses applicable to property damage claims.
Where the damaged vehicle is comprehensively insured or the damaged property is covered under a policy of insurance, the Agreement stipulates that the claim must be dealt with by the insurer of the vehicle or property.
There is a Protocol in place between MIBI and all companies writing motor insurance here which guarantees protection of the No Claims Bonus where the comprehensive insurer compensates the policyholder on behalf of MIBI.
This Protocol ensures a speedy resolution of the claim and avoids delay in having the vehicle repaired.
